The meetings reportedly occurred on September 21 and 22, 2024, in New York City, totaling three hours, and a final 30-minute encounter on November 30, 2024, in Austin, Texas. St. Clair contends that Musk has shown minimal interest in their child's upbringing, alleging he has never proactively sought visitation or inquired about the child's well-being.
The paternity suit aims to formally acknowledge Musk as the father-in-law. St. Clair states that their relationship began in May 2023 and fertilization of the embryo occurred in January 2024 during a trip to St. Barths. There is an endorsing statement and a text message, purportedly in possession of Musk and the woman. In one such exchange following the child's birth, Musk allegedly responded to a photo of the newborn with, "I look forward to seeing you and him this weekend.". In another message, addressing security concerns, Musk purportedly stated, "If I make a mistake on security, [R.S.C. will never know his father]" [i.e., recognition of his paternity].
Attempts at Private Resolution
St. Clair's attorney, Karen B. Rosenthal, asserts that efforts were made to resolve the matter privately. Correspondence with Musk's legal representative, Alyssa Rower of Rower, LLC, reportedly yielded no response, prompting the decision to pursue legal action. Rosenthal highlighted the possible function of Court action for addressing custody and support concerns, particularly in light of Musk's announcement of publicity, high profile, and demanding professional schedule.

In contrast, St. Clair's argument of legal custody in isolation also reflects a wish to maintain ultimate control over her son's upbringing.
